UC Berkeley Center for Executive Education is a California nonprofit organization formed for the purpose of operating executive education programs in support of UC Berkeley and the Haas School of Business.

Berkeley Executive Education (“we,” “us,” or “our”) respects your privacy and is committed to the protection of personal information that you choose to provide us through our site. The following privacy policy (this “Privacy Policy”) informs you of our policies regarding the collection, use, and disclosure of all personally identifiable information (“Personal Information”), and any other data that is provided to us through use of our site. Berkeley Executive Education is a unit of Haas School of Business. This Policy applies to information that we collect through our websites and other services.

Our Services include the web domains executive.berkeley.edu and go.executive.berkeley.edu and website pages for our global partner programs, which are hosted by our educational partners - Eruditus, Emeritus, and Northwest. This Policy does not apply to information that we collect from you in others ways (for example, information that you provide over the telephone, by fax, through conventional mail or email or any information that you may provide to us or Haas School of Business independently of our websites and Services).

Other than as required by statutes guaranteeing public access to specific types of information, in response to subpoenas or other legal instruments authorizing access, and in alignment with UC Berkeley’s Policy Governing Disclosure of Information from Student Records, Personal Information is not shared without your permission. Further, Berkeley Executive Education will not sell, rent, loan, or trade any Personal Information collected to third parties for a commercial purpose without your permission.  

Although we are affiliated with UC Berkeley, we are an independent organization.  As a result, should there be any conflict between the provisions of this Privacy Policy and the terms of UC Berkeley’s privacy policies, other than UC Berkeley’s Policy Governing Disclosure of Information from Student Records, the terms of this Privacy Policy will govern.

We may provide access to or share your Personal Information with select third parties who perform services on our behalf, including billing, fraud prevention, and payment processing. However, any third parties who are given access to your Personal Information will be prohibited from using your Personal Information for purposes other than to perform services on our behalf.

This Privacy Policy has been developed with the recognition that information technologies evolve rapidly and that such changes may require us to update our Privacy Policy. We reserve the right to alter our Privacy Policy at any time without notification.
Every email we send will contain a clearly-labeled “unsubscribe” link in its footer that allows you to opt-out of future communications. Further, you may unsubscribe by contacting us at executive@berkeley.edu.

What Personal Information We Collect:


We do not collect Personal Information about you unless you choose to provide us with such information. The information we collect includes Personally Identifiable Information when you register for a program, download a brochure, fill out a Contact Us form, participate in our online programs, or otherwise communicate with Berkeley Executive Education Online. Personally Identifiable Information means your full name and other information that personally identifies you.

If you enroll in one of our programs, you will be asked to provide certain information such as your name, email address, telephone number, billing address, and payment information.  Similarly, if you download a program brochure or similar educational materials, you will be asked to provide your name, company, job title, email address, and phone number.

If you would prefer that we not collect any Personal Information from you, please do not provide us with such information. When you submit your Personal Information on our site, you are giving your consent to the collection, use, and disclosure of your Personal Information as set forth in this Privacy Policy.  We may also collect, use, store, and share certain usage information and system identifiers and metadata. A child must be at least 16 years old to provide consent, otherwise, consent must be provided by the parent or guardian.

How We Use the Personal Information We Collect:


We may use, store, aggregate and disclose some or all of the data we collect from you and other users of the Services for the purposes set out in this Policy.

We may use your Personal Information to: provide you with information you have expressly chosen to receive or download [with your consent]; review and respond to your questions [with your consent]; enroll you in our programs [to perform a contract with you]; administer, safeguard, and improve our site [for our legitimate interests]; protect our rights and the safety of others [for our legitimate interests]; and/or comply with applicable law, court order, subpoena, or legal process served on us [to comply with legal obligations].

We may collect information about participant performance and patterns of learning. In addition, we may track information indicating, among other things, which portions or pages of a Service were visited, the order in which they were visited, when they were visited and which hyperlinks and other user interface controls were used.

We may collect, use, store, and share a variety of information, including IP address, operating system, unique IDs of cookies, unique IDs sent from mobile devices, network carriers or data providers, device types, browser types, version and language, Internet Service Provider (ISP) information, referring and exit websites and applications, attributes of computer or device usage, date/time stamps, click-through URLs, information contained in HTTP headers or other internet transfer protocol signals, clickstream data and other similar data, for each user of a Service or any Berkeley Executive Education, and we may be able to determine your geographic location (or the location of your device or ISP) with such data. Various web analytics tools are used to collect this information. Some of the information may be collected through cookies, pixel tags, scripts, log files, web beacons and other similar technologies.

Comments or other information posted or contributed by you to any part of a service designed to be visible to the public or to other Berkeley Executive Education Online participants may be viewed and downloaded by others who use or access the service. Please bear this in mind when you post such comments or other information.

Legal Bases under GDPR:


If you are in the European Economic Area (“EEA”), we will collect and use your Personal Information only if we have one or more legal bases for doing so under the General Data Protection Regulation (“GDPR”). For the purposes of the remainder of this section, references to “you” refer to users of our site located within the EEA or other non-U.S. territories.

Our legal bases for the collection and use of your Personal Information depend on your interaction with us and our site. This means we collect and use your Personal Information only where: you have given your consent for one or more specific purposes; it is necessary to perform a contract we are about to enter into or have entered into with you; it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; it is necessary to protect the vital interests of you or another natural person; or it is necessary to comply with a legal obligation. We will indicate in brackets the legal basis or bases on which we are relying following each purpose (see “How We Use the Personal Information We Collect” above). Where we are relying on consent as the legal basis, we will notify you and seek additional consent before using your Personal Information for a new purpose that is inconsistent with the original purpose for which we collected it.

Collection and Use of Non-Personal Information:


We may collect non-personal information, or data in a form that does not, on its own, permit direct association with any individual. For example, we may use automatic data collection technologies to collect and store details of how you use our site. This “usage data” is limited to information related to your interactions with our site. The technologies we use for usage data collection include:

Cookies

Cookies may be issued when you visit our site. We may place a cookie on your computer or device so we can recognize you as a return user and personalize your experience and your use of our site. We also use cookies to help us understand how you engage with our site. Most browsers and mobile devices offer instructions on how to disable cookies (typically in “Preferences” or “Settings”). If you disable our cookies, some functions and conveniences of a service may not work properly or at all.

Third-party analytics services

We use third-party analytics services, including Google Analytics and others, to collect information about your use of our site and enable us to improve our site. Google Analytics and other third-party analytics services use cookies and similar technologies to collect information about the use of our site and to report trends to us, without identifying individuals.

Click-through URLs

If you “opt in” to receive emails from us, our emails may use a “click-through URL” linked to content on our site. When you click one of these URLs, they pass through a separate web server before arriving at the destination page on our site. We use this click-through data to help us understand how recipients respond to our emails.  If you prefer not to be tracked in this way, please do not click text or graphic links in emails you receive from us.

Log Files

We gather certain information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type, and internet service provider (ISP).  We use this information, which is not linked to Personal Information, to analyze trends, to administer our site and to track users’ movements around our site.

Please be aware that we do not currently honor “do not track” requests.

Storage and Transfer of Your Personal Information:
The information you provide us may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where data protection laws may be different from those of your jurisdiction. By providing information on our site, you hereby expressly consent to such a transfer for the purposes described herein.  

For the purposes of the remainder of this section, references to “you” refer to users of our site located within the EEA or other non-U.S. territories.

For users of our site located within the EEA or other non-U.S. territories, please note that any information you provide on our site will be transferred outside the EEA or such other non-U.S. territory for use by us as described herein.

The GDPR and other applicable data protection laws provide certain rights for EEA residents. You are entitled to review the Personal Information we hold about you as well as details on how we process such Personal Information. You also have a right in accordance with the GDPR to have your Personal Information corrected or erased, to restrict our processing of that Personal Information, to stop unauthorized transfers of your Personal Information and, in some circumstances, to have your Personal Information transferred to another organization designated by you. You also have the right to lodge a complaint in relation to our processing of your Personal Information with your local supervisory authority. If you do not request to have your Personal Information erased, it may be maintained by us indefinitely.

If you object to the processing of your Personal Information, or if you have provided your consent to processing and you later choose to withdraw it, we will respect that choice in accordance with our legal obligations.

Your objection (or withdrawal of any previously given consent) could mean that we are unable to perform the actions necessary to achieve the purposes set out above. Please note that even after you have chosen to withdraw your consent, we may continue to process your Personal Information to the extent required or otherwise permitted by law, in particular in connection with exercising and defending our legal rights or meeting our legal and regulatory obligations.

While using our site, you may encounter hypertext links to the web pages of other UC Berkeley websites or organizations not directly affiliated with Berkeley Executive Education. The Berkeley Executive Education website complies with this Privacy Policy; however, Berkeley Executive Education does not control the content nor information gathering practices of other UC Berkeley sites or external organizations. We recommend that you review the privacy statements of these organizations prior to sharing any Personal Information with them.

Your California Privacy Rights:


Under California Civil Code sections 1798.83 - 1798.84, California residents may request from us certain information with respect to the types of information we share with third parties for direct marketing purposes by such third parties, and the identities of the third parties with whom we have shared such information during the immediately preceding calendar year. Rights of the Data Subject: 


You have the right to request the collection of your data from our systems. You have the right to request incorrect data to be corrected, and incomplete data to be supplemented, without undue delay. As a data subject, you have the right to request your data to be erased (right to be forgotten) from our system, if you no longer want your data to be processed by us, or the right to limit the processing of your data when you do not want your data erased and still want our organization to continue storing the data.

Children:


Our Services are generally not intended for users under the age of 18. We will not knowingly collect Personal Information from children under age 13.
